Taxes and tax residence: Malaysia
MDEC's own guide explains the tax treatment under the Income Tax Act 1967. If you work remotely for an employer abroad, you are not taxed if you spend 60 days or fewer in Malaysia; from day 61, that income can be taxed, depending on your residence status and your country's treaty. If you are a freelancer, a 10% withholding (or the treaty rate) applies for the first 182 days, and after that you are taxed as a resident carrying on a business.

Remote work can be taxed
MDEC's own guide explains the tax treatment under the Income Tax Act 1967. Register before you receive the pass
To endorse the pass you need proof of taxpayer registration with the LHDN, done online through MyTax. Tax withheld in the first months is credited when you file your return. For stays longer than 182 days, check your tax residence with an adviser and how to report in your home country.
Prepare your tax consultation
Gather stay dates, previous residence, contract, clients and income by category. Ask about treaty, registration, returns, VAT and contributions for your profile, and deadlines for the relevant year. Special benefits require confirming conditions and application.
Things to keep in mind
These points vary with your situation, your home country or the consulate. They are worth confirming with the official source before you take the next step.
- How many days you will spend in Malaysia each year and from when you are taxed.
- What the treaty between Malaysia and your country says about independent services or employment.
